TECH Ripple says it will fight the SEC lawsuit ‘all the way through

Monica Long, Ripple’s president, told CNBC on Monday that she plans to fight the case until the end.

Ripple and the SEC filed their lawsuit nearly three years ago.

By selling $1.3 billion of its native cryptocurrency XRP without first registering it as a security, Ripple and its co-founders violated securities laws in 2020.

XRP, according to Ripple, is not a security and is more like a commodity. A landmark ruling by District Judge Analisa Torres determined that the token was not necessarily a security.

In that lawsuit, we also gained clarity. According to the judge’s order, XRP itself is not a security, which lets us really expand our business – not just in the U.S. but globally as well,” said Long. Ripple is not the only one. The SEC is also suing other crypto companies, including Binance and Coinbase.

There has been criticism of the U.S. government’s approach to regulation, particularly in regards to its lack of clarity.

As a result of the SEC’s crackdown, Coinbase and Ripple have threatened to leave the country.

A few weeks after Judge Torres’s ruling, also sitting in the Southern District of New York, Judge Jed Rakoff ruled that “the Court rejects the approach recently adopted by another judge in a similar case.”
