In response to Bijou Phillips’ initial divorce petition, Danny Masterson filed his own paperwork.

Additionally, Masterson asked Phillips, 43, for physical and legal custody of Fianna, their 9-year-old daughter.

He was sentenced to 30 years to life in prison in September after being found guilty in May of two counts of forcible rape. A third charge was hung by the jury.

Within two weeks, Phillips filed for divorce, and Masterson requested visitation rights.

While Masterson filed his own response, a court will make the final decision regarding custody arrangements, according to celebrity divorce attorney Christopher C. Melcher.

Melcher told Fox News Digital that Danny agrees with the court awarding custody to Bijou, with visitation to him, but no order can be made on that issue until a hearing or settlement takes place. 

The parties will probably ask the court to approve a settlement on all issues because Danny is serving a lengthy prison sentence and will only be able to see the child when he visits prison.
